1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of services provided by lumoresa ("we," "our," or "us"), a residential care facility located in Phuket, Thailand. By engaging our services, visiting our facility, or using our website, you agree to these Terms. If you do not agree, please do not use our services or website.

These Terms constitute a legally binding agreement between you (the "User," "Resident," or "Family Member") and lumoresa.

2. Definitions

  • "Services" refers to all residential care, support, and activities provided by lumoresa
  • "Resident" means an individual receiving care services at our facility
  • "Family Member" means authorized relatives or representatives of a Resident
  • "Agreement" refers to these Terms plus any signed service contracts
  • "Facility" means lumoresa's residential care premises in Rawai, Phuket

3. Eligibility and Admission

To be eligible for our services:

  • Residents must be 18 years of age or older
  • Residents or their authorized representatives must have legal capacity to enter into this agreement
  • Care needs must align with services we can appropriately provide
  • All required documentation and health assessments must be completed
  • Payment arrangements must be established prior to service commencement

4. Service Description

4.1 Scope of Services

lumoresa provides non-medical residential care services including everyday living support, leisure activities, and comprehensive residential packages as detailed on our website. Services are provided in accordance with individual care plans developed in consultation with Residents and Family Members.

4.2 Service Availability

We strive to maintain consistent service delivery. However, services may be modified or temporarily unavailable due to circumstances beyond our control, including emergencies, maintenance, staffing changes, or regulatory requirements.

4.3 Medical Services

lumoresa is not a medical facility. We do not provide medical treatment or nursing care. Residents requiring medical attention will be directed to appropriate healthcare providers.

5. Payment Terms

5.1 Fees and Pricing

Service fees are quoted in Thai Baht (฿) and are subject to the package selected. Current pricing is available on our website and in service agreements. We reserve the right to adjust pricing with 30 days written notice.

5.2 Payment Methods

Payment may be made via bank transfer, cash, or other methods as agreed. Monthly fees are due on the first day of each month unless otherwise specified in your service agreement.

5.3 Late Payment

Late payments may incur administrative fees. Continued non-payment may result in service suspension or termination as permitted by law.

5.4 Refund Policy

Refunds are handled on a case-by-case basis. Generally, fees paid for services rendered are non-refundable. Advance payments for future months may be refunded according to the terms of your service agreement.

6. Resident Responsibilities

Residents and Family Members agree to:

  • Provide accurate and complete information regarding health status and care needs
  • Notify staff of changes in health condition or care requirements
  • Respect the rights, privacy, and dignity of other residents and staff
  • Follow facility rules and safety protocols
  • Pay fees on time according to the agreed schedule
  • Provide emergency contact information and keep it current
  • Cooperate with care planning and service delivery

7. Facility Rules and Conduct

7.1 Prohibited Activities

The following are prohibited on our premises:

  • Behavior that threatens safety or wellbeing of others
  • Illegal drug use or excessive alcohol consumption
  • Harassment, discrimination, or abusive conduct
  • Damage to property or facilities
  • Unauthorized removal of facility property

7.2 Visiting Policy

While we maintain an open visiting policy during operating hours, we reserve the right to restrict access for individuals who violate facility rules or pose safety concerns.

8. Privacy and Confidentiality

Personal information is handled according to our Privacy Policy and applicable Thai data protection laws. Residents have the right to privacy in their rooms and personal communications. We share information with Family Members only with Resident consent, except in emergencies or as required by law.

9. Liability and Disclaimers

9.1 Service Disclaimer

Services are provided on an "as is" basis. While we strive to maintain high-quality care, we make no guarantees regarding specific outcomes or results.

9.2 Limitation of Liability

To the fullest extent permitted by Thai law, lumoresa's liability is limited to the fees paid for services during the three months preceding any claim. We are not liable for indirect, consequential, or punitive damages.

9.3 Personal Property

Residents are responsible for their personal belongings. We recommend against keeping valuable items at the facility. lumoresa is not liable for loss or damage to personal property except in cases of gross negligence.

9.4 Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or other force majeure events.

10. Termination

10.1 Termination by Resident

Residents may terminate services with 30 days written notice. Fees for the notice period remain payable.

10.2 Termination by lumoresa

We may terminate services with 30 days notice, or immediately in cases of:

  • Non-payment of fees after reasonable notice
  • Behavior threatening safety of residents or staff
  • Care needs exceeding our service capabilities
  • Material breach of this Agreement

10.3 Effects of Termination

Upon termination, all fees become immediately due, and Residents must vacate the premises within the specified timeframe.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be subject to the jurisdiction of Thai courts.

11.2 Informal Resolution

Before pursuing formal legal action, parties agree to attempt good faith resolution through direct communication with facility management.

12. General Provisions

12.1 Entire Agreement

These Terms, together with any signed service agreements and our Privacy Policy, constitute the entire agreement between parties.

12.2 Severability

If any provision is found invalid, the remaining provisions continue in full effect.

12.3 Waiver

Failure to enforce any right does not constitute a waiver of that right.

12.4 Assignment

You may not assign or transfer your rights under this Agreement without our written consent.

12.5 Amendments

We may modify these Terms with 30 days notice. Continued use of services after changes constitutes acceptance of modified Terms.
